OVERVIEW

Welcome to PulseRelief™. The terms "we", "us" and "our" refer to PulseRelief™, a trading name of Nuvalex LLC. PulseRelief™ operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). PulseRelief™ is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as product safety, warranty disclaimers and limitations of liability.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

SECTION 1 — ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least 18 years of age, or the age of majority in your state, province or country of residence.

To use the Services, including accessing or browsing our online store or purchasing any of the products we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our store is correct, current and complete and that you have all rights necessary to provide this information.

You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

SECTION 2 — OUR PRODUCTS

PulseRelief™ offers a range of muscle recovery, pain relief and general wellness products. Our current range includes percussion massage devices, back stretching and posture support devices, acupressure and pressure-point products, and related accessories.

We may add further products to our range from time to time. These Terms apply to all products offered through the Services, and any product-specific conditions will be set out on the relevant product page.

We have made every effort to provide an accurate representation of our products in our online store. However, please note that colours or product appearance may differ from how they appear on your screen due to the type of device you use to access the store and your device settings and configuration.

All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region or jurisdiction, on a case-by-case basis.

SECTION 3 — PRODUCT SAFETY AND HEALTH DISCLAIMER

Please read this section carefully before using any PulseRelief™ product.

Our products are not medical devices

PulseRelief™ products are general wellness and recovery products. They are not medical devices, and they are not intended to diagnose, treat, cure, or prevent any disease, injury or medical condition.

Nothing on our website, in our product descriptions, in our marketing materials, or in any communication from us constitutes medical advice. Information provided is for general informational purposes only and is not a substitute for professional medical advice, diagnosis or treatment.

Consult a healthcare professional before use

You should consult a qualified doctor or physiotherapist before using our products if any of the following apply to you:

• You are pregnant or may be pregnant
• You have a pacemaker, defibrillator or any other implanted medical device
• You have deep vein thrombosis, a blood clotting disorder, or any circulatory condition
• You take blood-thinning medication
• You have osteoporosis, fragile bones, or a history of fractures
• You have a herniated disc, spinal injury, scoliosis, or any diagnosed spinal condition
• You have had recent surgery, a recent fracture, or an unhealed injury
• You have diabetes, neuropathy or reduced skin sensitivity
• You have varicose veins, open wounds, skin infections or inflamed skin
• You are undergoing treatment for cancer
• You have any other medical condition that may be affected by massage, pressure or spinal extension

Safe use

• Read the instructions supplied with your product before first use.
• Begin at the lowest intensity or height setting and increase gradually.
• Never use a percussion device directly on the spine, head, throat, front of the neck, joints, bones, or any area that is bruised, swollen or painful.
• Percussion and pressure-point products may cause temporary redness or bruising, particularly at higher intensities or with prolonged use on one area. Move the device regularly and keep sessions short.
• Stop using the product immediately if you experience pain, dizziness, numbness, tingling or discomfort, and seek medical advice.
• Do not use our products on children, or on any person who cannot clearly communicate discomfort, without medical supervision.
• Do not exceed the stated weight limit or recommended session duration for the product.

Your responsibility

You are responsible for using our products safely and in accordance with the instructions provided. To the fullest extent permitted by law, we accept no liability for injury or harm resulting from misuse, from use contrary to the guidance above, or from use despite a medical condition for which you did not seek professional advice.

Nothing in this section limits our liability for death or personal injury caused by our negligence, or any other liability that cannot be excluded under applicable law.

SECTION 4 — ORDERS

When you place an order, you are making an offer to purchase. PulseRelief™ reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until PulseRelief™ confirms acceptance. We must receive and process your payment before your order is accepted.

Please review your order carefully before submitting. You may cancel your order before it is dispatched by contacting us at hello@pulserelief.shop; once an order has been dispatched, our Refund Policy applies.

In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the email, billing address, and/or phone number provided at the time the order was made.

Your purchases are subject to return or exchange in accordance with our Refund Policy and with your statutory rights.

Our products are offered for personal or household use. We may decline orders that appear to be placed for commercial resale.

SECTION 5 — PRICES, TAXES AND BILLING

All prices are shown and charged in US dollars (USD). Prices, discounts and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed and will be set out in your order confirmation email.

Import duties and taxes. For deliveries to the United Kingdom, France and Germany, we ship on a Delivered Duty Paid basis: import duties and taxes are included in the price you pay, and you will not be asked to pay additional charges before your parcel is released.

For deliveries to the United States and Canada, any import duties, taxes or customs charges applied by the authorities in your country are not included in the price shown and are your responsibility. Please check with your local customs office if you are unsure what may apply.

You agree to provide current, complete and accurate purchase, payment and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and payment card information, so that we can complete your transactions and contact you as needed.

SECTION 6 — SHIPPING AND DELIVERY

We offer free shipping to the United States, Canada, the United Kingdom, France and Germany. We do not currently deliver to other destinations.

All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our reasonable control.

Full details of delivery times, customs treatment and our obligations in the event of loss or delay are set out in our Shipping Policy, which forms part of these Terms.

SECTION 7 — INTELLECTUAL PROPERTY

Our Services, including all trademarks, brands, text, displays, images, graphics, video, and audio, and the design, selection, and arrangement thereof, are owned by PulseRelief™, its affiliates or licensors and are protected by applicable copyright and other intellectual property laws. Customer reviews and other content submitted by users are governed by Section 11.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent.

SECTION 8 — OPTIONAL TOOLS AND THIRD-PARTY LINKS

You may be provided with access to tools offered by third parties as part of the Services, which we neither monitor nor control. Any use by you of such optional tools is entirely at your own risk and discretion.

The Services may contain materials and hyperlinks to websites provided or operated by third parties. We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites you choose to access, and we are not liable for any harm or damages related to your access of any third-party websites.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

PulseRelief™ is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with PulseRelief™. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and PulseRelief™. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with PulseRelief™.

SECTION 10 — PRIVACY POLICY

All personal information we collect through the Services is subject to our Privacy Policy. By using the Services, you acknowledge that you have read our Privacy Policy.

SECTION 11 — REVIEWS AND FEEDBACK

If you submit any ideas, suggestions, feedback, or reviews, you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute and display such feedback in any medium for any purpose. This licence does not affect any moral rights you hold under applicable law.

You confirm that any review you submit reflects your genuine experience of the product. Reviews on our store are collected and displayed through Judge.me.

We may, but have no obligation to, monitor, edit or remove feedback that we determine to be unlawful, offensive, fraudulent, or otherwise objectionable.

SECTION 12 — ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on or in the Services that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times or availability.

We reserve the right to correct any errors, inaccuracies or omissions at any time without prior notice, and to cancel any order placed on the basis of inaccurate information. Where an order is cancelled for this reason, you will receive a full refund.

SECTION 13 — PROHIBITED USES

You may access and use the Services for lawful purposes only. You may not use the Services for any unlawful purpose, to violate any regulations or laws, to infringe upon intellectual property rights, to harass or harm any person, to transmit false or misleading information, or to engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Services.

SECTION 14 — TERMINATION

We may terminate this agreement or your access to the Services where you have breached these Terms, or where we reasonably suspect fraudulent or unlawful activity. You will remain liable for all amounts due up to and including the date of termination.

Termination does not affect any order already accepted and paid for, or your statutory rights in relation to that order.

SECTION 15 — YOUR STATUTORY RIGHTS AS A CONSUMER

Nothing in these Terms of Service excludes, restricts or modifies any rights you have as a consumer that cannot be excluded, restricted or modified under the law applicable to you.

In particular:

United Kingdom: your rights under the Consumer Rights Act 2015 — including that goods must be of satisfactory quality and fit for purpose — and under the Consumer Contracts Regulations 2013, are unaffected by these Terms.

France and Germany: your rights under Directive (EU) 2019/771 on the sale of goods, including the two-year legal guarantee, and under Directive 2011/83/EU on consumer rights, are unaffected by these Terms.

Sections 16 and 17 below apply only to the extent permitted by the law applicable to you.

SECTION 16 — DISCLAIMER OF WARRANTIES

Subject to Section 15, and to the fullest extent permitted by applicable law, the Services and all products offered through the Services are provided "as is" and "as available" for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, fitness for a particular purpose, durability, title, and non-infringement.

SECTION 17 — LIMITATION OF LIABILITY

Subject to Section 15, and to the fullest extent permitted by law, in no case shall PulseRelief™, our partners, directors, officers, employees, affiliates, agents, contractors, service providers or licensors be liable for any indirect, incidental, punitive, special, or consequential damages of any kind arising from your use of any of the Services or any products procured using the Services.

Where liability cannot lawfully be excluded, our total liability to you in connection with any order shall not exceed the amount you paid for that order.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

SECTION 18 — INDEMNIFICATION

You agree to indemnify, defend and hold harmless PulseRelief™, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable legal fees, arising out of your breach of these Terms of Service, your violation of any law or the rights of a third party, or your access to and use of the Services.

This section does not apply to consumers to the extent that such an indemnity would be unenforceable under the consumer protection law applicable to you.

SECTION 19 — SEVERABILITY; WAIVER; ENTIRE AGREEMENT

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms.

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

These Terms of Service, together with our Privacy Policy, Shipping Policy and Refund Policy, constitute the entire agreement between you and us and govern your use of the Services.

SECTION 20 — GOVERNING LAW AND DISPUTES

These Terms of Service are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law provisions, and you and PulseRelief™ submit to the jurisdiction of the courts of that state.

However, if you are a consumer resident in the United Kingdom, France or Germany, this does not deprive you of the protection afforded to you by the mandatory consumer protection laws of your country of residence, and you may bring proceedings in the courts of your country of residence.

SECTION 21 — CHANGES TO TERMS OF SERVICE

We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website.

The terms applicable to your order are those in force at the time you place that order.
